Why Investing in Family Engagement Can Reduce Special Education Litigation Costs

Harvard’s piece highlights a growing body of research showing that when schools invest in relationship-building with families, especially those whose children receive special education services, they create a foundation of trust. That trust is a powerful protective factor. When families feel heard, respected, and informed, they are significantly less likely to pursue formal complaints—even when challenges arise.
Litigation, after all, often emerges when parents feel they have no other option. Proactive family engagement can prevent misunderstandings from escalating into legal conflict.

In contrast, targeted investments in family engagement strategies (such as staff training, communication systems, and culturally responsive outreach) are far more affordable—and deliver long-term benefits.
